1. Acceptance of Terms

By registering for or using Spectlance Bulk SMS ("Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.

2. Description of Service

Spectlance Bulk SMS provides a web-based bulk SMS platform enabling registered clients to send, schedule, and manage SMS communications to contact lists. Features include single SMS, bulk scheduled campaigns, recurring messages, birthday SMS, inbox management, and API access.

3. Account Registration

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must promptly notify us of any unauthorised use of your account.
  • We reserve the right to refuse registration or suspend accounts at our sole discretion.

4. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited, or harassing messages.
  • Transmit illegal, fraudulent, or deceptive content.
  • Impersonate any person or entity.
  • Violate any applicable law, regulation, or third-party rights.
  • Send messages to recipients who have opted out.
  • Use the Service for phishing, malware distribution, or any malicious activity.

Violations may result in immediate suspension of your account and, where applicable, reporting to authorities.

5. SMS Credits and Billing

  • The Service operates on a pre-paid credits model. Credits must be purchased before sending messages.
  • One (1) credit is consumed per standard 160-character SMS. Longer messages consume additional credits proportionally.
  • Credits are non-refundable once purchased, except where required by applicable law.
  • Pricing is subject to change with 14 days' notice to registered account holders.

6. Delivery

While we strive for high delivery rates, we cannot guarantee delivery of every message. Delivery depends on factors outside our control including recipient network conditions and handset availability. We are not liable for undelivered messages.

7. Sender ID

You must only use Sender IDs that you are authorised to use. Misuse of Sender IDs belonging to third parties is strictly prohibited and may result in account termination and legal action.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

All intellectual property rights in the Service and its underlying technology remain vested in Spectlance Bulk SMS. You are granted a limited, non-exclusive licence to use the Service for its intended purpose only.

10. Limitation of Liability

To the maximum extent permitted by law, Spectlance Bulk SMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our aggregate liability shall not exceed the amount paid by you in the three months preceding the claim.

11. Termination

Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease. Unused credits will not be refunded. We reserve the right to retain data as required by law.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts.

13. Changes to These Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify account holders of material changes by email.
